The relentless barrage began subtly, then escalated into a constant stream of hurtful remarks. Bernadette Hayes described the experience as “a death by 1,000 cuts,” a slow erosion of her spirit at the hands of her employer.

The harassment took a particularly insidious form, targeting her Irish heritage. A potato emoji appeared in a WhatsApp message, followed by repeated, derogatory references to her as a “gypsy” or “traveller.”
He would openly speculate about her supposed attraction to travellers outside the office, a cruel and baseless accusation that amplified her feelings of being bullied and harassed. The constant scrutiny felt like a violation, leaving her feeling small and insecure.
Despite her distress, Bernadette initially felt trapped, believing she had no choice but to endure the abuse to keep her job. The weight of the ongoing harassment, however, eventually became unbearable.
By July, the cumulative effect of the attacks led to a complete breakdown, forcing her to take sick leave due to overwhelming stress. She finally filed a formal grievance, articulating the profound damage inflicted over the preceding months.
Her employer dismissed the proceedings as “nonsense from start to finish” and subsequently dismissed Bernadette. This act, however, would prove to be a critical misstep.
Employment Judge Sophie Buckley ruled decisively in Bernadette’s favor, recognizing the overtly racial nature of the offensive language. The judge found the repeated use of terms like “potato,” “paddy,” “stupid paddy,” and “pikey” to be undeniably humiliating and offensive.
Judge Buckley acknowledged the subjective impact of the harassment, stating it created a hostile and offensive environment for Bernadette. The court awarded her £20,736 in compensation, along with an additional £2,800 for four weeks’ pay.
The ruling stands as a powerful affirmation of the importance of protecting individuals from racial harassment in the workplace, and a testament to the courage of those who come forward to challenge such behavior.
