Bernadette Hayes endured a slow, agonizing erosion of her spirit – a “death by 1,000 cuts,” as she described it – stemming from relentless, offensive remarks at work. The constant barrage chipped away at her confidence, creating a deeply hostile environment.
The situation escalated after a colleague, Marcus Smith, became involved in the business. What began as unsettling comments quickly morphed into a pattern of deliberate humiliation, designed to undermine and belittle her.
Hayes recounted instances where her employer would repeatedly shout “potato” in a mocking Irish accent, often in front of other staff members. The word, hurled at her even before any interaction, became a symbol of her degradation and a constant reminder of her perceived otherness.
This relentless abuse systematically dismantled her self-respect and left her feeling vulnerable, insecure, and profoundly anxious. The embarrassment was acute, compounded by personal challenges that made her feel trapped and dependent on the job.
The harassment wasn’t confined to the office; it seeped into personal communication. A simple WhatsApp exchange was tainted by the same demeaning term, further blurring the lines between work and personal life.
Beyond the “potato” taunts, Hayes was subjected to racial slurs, being called a “gypsy/traveller” due to her Irish heritage. Her employer falsely accused her of being attracted to travellers outside the office, adding another layer of bullying and harassment.
Despite repeatedly stating that she found the comments deeply offensive, the abuse continued. On the rare occasions she attempted to deflect the negativity by responding in kind, she did so only to try and fit in and diffuse the situation.
The mounting stress ultimately forced Hayes to take sick leave in July 2024, acknowledging her unhappiness and the unfairness of continuing in such a toxic environment. She formally raised a grievance, describing the situation as “bullish” and detailing the indirect harassment she experienced.
In her grievance, Hayes powerfully articulated the cumulative effect of the abuse, stating the last six months had felt like a relentless assault on her well-being. Her doctor signed her off work, citing work-related stress after months of harassment and bullying.
Despite her efforts, Hayes was later dismissed from the company. However, her case didn’t end there. An Employment Judge recognized the profound impact of the conduct, acknowledging the hostile, humiliating, and offensive environment created for Hayes.
Judge Buckley ruled that the repeated use of terms like “potato,” “paddy,” “stupid paddy,” and “pikey” were “overtly linked to race,” particularly when considered together. This clear connection established a successful claim of harassment based on her Irish heritage.
The judge awarded Hayes £20,735.91 in compensation, acknowledging the subjective harm caused by the employer’s actions. The ruling underscored the severity of the abuse and its detrimental effect on her well-being.
The judgment served as a stark reminder of the devastating consequences of workplace harassment and the importance of creating a respectful and inclusive environment for all employees.
