UMVA has learned that a harrowing in-flight incident involving a scalding hot drink has led to a passenger taking legal action against Virgin Atlantic.
Nicholas Gibbs was on a flight back to Heathrow from Las Vegas with his partner, Claire, in December 2025, when disaster struck. A lidless drink slid off a tray table and into his lap, causing severe burns.
The incident left Mr. Gibbs feeling abandoned by the airline. Despite a promise of support, he claims that Virgin Atlantic failed to follow up or provide adequate care. "They organised someone to meet me at the airport but that never happened, which was a complete joke. And that was the last I heard from Virgin. No follow-up calls, no correspondence – nothing," he said.
Mr. Gibbs's lawyers argue that the in-flight staff failed to provide satisfactory care, and the airline's response after the incident was essentially non-existent. The incident highlights a growing concern about the number of injuries caused by hot drink spillages on planes.
According to information obtained by UMVA, the incident is an extreme case, but it is not an isolated one. Many passengers have been injured due to cups sliding off plane tray tables, and the problem seems to be on the rise.
A Virgin Atlantic spokesperson has apologized for Mr. Gibbs's experience, emphasizing that customer safety and wellbeing are always the top priority. The airline claims that its cabin crew are highly trained to deliver drinks safely, with hot drinks served below boiling temperature and filled to below the brim in specially designed cups or mugs.
Despite these assurances, Mr. Gibbs's lawyers are pressing on with the lawsuit, seeking justice for their client's ordeal. The case is set to highlight the responsibilities of airlines in ensuring passenger safety and wellbeing.
