UMVA has learned that a harrowing domestic tragedy in Toronto ended with a three‑and‑a‑half‑year prison term for Deeanna Charrion, who was convicted of manslaughter after the death of her long‑time partner, Gerrard “Gerry” Martin.

The courtroom drama unfolded as Superior Court Justice Breese Davies rejected both the defense’s plea for a two‑year conditional sentence and the Crown’s request for an eight‑year term, ultimately imposing a middle ground that reflected the brutal reality of the case.

According to information obtained by UMVA, the couple’s five‑year relationship had been a vortex of addiction, violence, and relentless accusations, with Martin—60, a lottery winner living alone on the second floor of a semi‑detached house—regularly accused Charrion of infidelity, while she often erupted in screaming tirades and occasional blows.

On the night of January 22, 2024, the pair left a downtown bar, only for Charrion to return to Martin’s apartment while heavily intoxicated—she later described her level of drunkenness as “an eight out of ten.”

Between 5 p.m. and 10 p.m., Martin called her more than twenty‑five times, a barrage that ignited a fierce argument. Within minutes of her arrival, the dispute escalated, and Charrion admitted she “got in his face” and pursued him through the kitchen and living room.

Witnesses and forensic evidence later showed that Martin, whose blood alcohol content was five times the legal limit, lost balance at the top of the stairs. The judge concluded that Charrion deliberately pushed him, sending him tumbling down the landing, breaking ribs, a shoulder blade, an arm, vertebrae, and sustaining a fatal subdural hemorrhage.

 Gerrard Martin, of Toronto, was assaulted by a woman near Danforth and Jones Aves. on Jan. 23, 2024, and died in hospital in hospital on Sunday, Feb. 18, 2024.

In a December 2025 verdict, a jury acquitted Charrion of second‑degree murder but found her guilty of manslaughter, rejecting her self‑defence claim and the notion that she had acted without intent.

Justice Davies highlighted a pattern of abuse: prior slaps, spitting, and venomous messages that called Martin a “useless a‑hole” and wished him “burned in hell.” Although a 2021 assault conviction existed, it could not legally factor into sentencing.

Compounding the cruelty, Martin suffered from emphysema and lung cancer, making his death in his own home at the hands of his intimate partner an aggravating circumstance, according to the judge.

Nevertheless, Davies noted Charrion’s remorse, two years of sobriety, and steps toward rehabilitation, describing the incident as “closer to an accident than a murder.”

Balancing denunciation and deterrence, the judge determined that a three‑and‑a‑half‑year term was the shortest custodial sentence capable of satisfying justice for this tragic, violent episode.
