Boca Bash itself is a sprawling, alcohol-fueled event that draws thousands of boaters annually, creating a chaotic and often unpredictable environment. Investigators and witnesses initially reported seeing Schwitzky jump into the water, attempting to swim to safety.

Authorities claimed Goldberg followed her, actively trying to submerge her before a bystander intervened. However, Goldberg maintained the situation was a misinterpretation born from the surrounding chaos. He insisted perceptions were skewed, leading to the serious charges against him.

Goldberg testified that he entered the water not to harm Schwitzky, but to help her after arranging transportation off the boat. He quickly found himself struggling against the current, experiencing genuine fear for his own life. “I just felt like I was drowning,” he recounted, describing it as the most terrifying moment of his life.

He explained that any physical contact with Schwitzky was minimal – a brief touch to his shoulder for buoyancy – and that this fleeting moment was tragically misconstrued. He vehemently denied any intention of causing harm, calling the accusations “ridiculous.”

The case hinged on conflicting accounts from eyewitnesses, each interpreting the same event through a different lens. Even those present struggled to agree on what truly transpired amidst the commotion on the water.
