A sweeping change has taken effect at the Department of Housing and Urban Development, halting the enforcement of a policy established during the Obama administration. Secretary Scott Turner has issued a directive to base all agency programs on biological sex, effectively pausing a key element of the 2016 Equal Access Rule.

The 2016 rule broadened the definition of gender identity within federally-funded housing programs and shelters, allowing individuals to self-identify their gender for access to services. This shift is now on hold, impacting how shelters and providers operate, particularly those offering refuge to women escaping domestic violence.

The move directly implements President Trump’s executive order, aiming to redefine federal government operations based on what the administration terms “biological truth.” Secretary Turner explicitly stated the agency will now recognize only two sexes: male and female.

Turner characterized the previous rule as aligning with “far-left gender ideology,” arguing it overstepped the role of government. He framed the change as a return to foundational principles, referencing a belief in a divinely ordained understanding of sex.

Critics of the 2016 rule voiced concerns that it infringed upon the rights of shelters, especially those dedicated to supporting women who have experienced trauma, abuse, and violence. They argued the rule limited their ability to prioritize the safety and well-being of their clients.

This directive isn’t a complete repeal of the Equal Access Rule, initially introduced in 2012 to prohibit discrimination based on sexual orientation, gender identity, and marital status. Instead, it specifically halts enforcement of the 2016 expansion that addressed gender identity recognition.

Turner signaled this is just the beginning of a broader policy overhaul within HUD. He emphasized a commitment to reviewing all programs and ensuring taxpayer dollars are used effectively to provide affordable housing and foster economic growth across the nation.

The stated goal is to refocus HUD’s mission on providing “quality, affordable homes” and strengthening communities, both urban and rural. Turner pledged further changes to align the agency’s spending with this renewed focus.
