A new wave of scrutiny has descended upon New York Attorney General Letitia James, as criminal referrals alleging potential insurance fraud have been sent to the Department of Justice. These referrals, initiated by Federal Housing Finance Agency Director Bill Pulte, center around properties connected to James and have been directed to U.S. attorneys for review in both Florida and Illinois.

The core allegation revolves around suspected homeowners insurance fraud. Documents obtained suggest James may have provided inaccurate information on an application to Universal Property Insurance, a Florida-based company, potentially misrepresenting the occupancy status of a property.

Pulte’s referral specifically points to claims that James asserted the property would be unoccupied for five months annually. However, information surfaced – originating from social media posts by attorney Mike Davis – indicating the property was, in fact, consistently occupied by James’ niece.

This discrepancy has fueled the claim that James knowingly misrepresented facts to secure insurance benefits, potentially constituting fraud. The Department of Justice confirmed receipt of the referrals, stating that U.S. Attorney Offices are now evaluating the information.

The case lands before Jason Quinones, the U.S. attorney for the Southern District of Florida, who holds the power to decide whether to pursue a prosecution. Should he deem the evidence sufficient, his office would then seek an indictment from a grand jury.

This development arrives after previous legal challenges against James were dismissed. Late last year, bank fraud charges were dropped by a judge who deemed the indictments illegitimate due to the involvement of an unqualified U.S. attorney. A subsequent attempt to re-indict James in Virginia also failed to gain traction with a grand jury.

The current referrals represent a renewed effort to investigate James’ conduct, focusing on a different set of allegations and a new legal pathway. The outcome hinges on the U.S. Attorney’s assessment of the evidence and the potential for a grand jury to return an indictment.

Requests for comment have been directed to James’ office and her legal counsel, but a response has not yet been publicly released. The situation remains fluid as the Department of Justice begins its review of the allegations.
