Deep within the Florida Everglades, a controversial immigration detention center nicknamed “Alligator Alcatraz” will remain open, following a recent appeals court decision. The ruling effectively overturns a previous order that demanded the facility begin shutting down due to violations of federal environmental law, plunging the future of this isolated outpost into further uncertainty.

The core of the legal battle revolves around the National Environmental Policy Act, a law requiring federal agencies to thoroughly assess the environmental consequences of major projects. However, the majority of the 11th Circuit Court of Appeals determined that because Florida, not the federal government, funded and constructed the facility, it wasn’t subject to these federal regulations.

Court documents reveal Florida received no federal funds for the construction, bolstering the argument that the state maintained complete control over the project. The facility stands on state-owned land, built entirely with state resources, a detail the court emphasized in its 2-1 decision.

But dissenting Judge Nancy Abudu sharply disagreed, arguing that immigration is fundamentally a federal responsibility. She contends the federal government cannot simply abdicate its authority by allowing a state to build and operate a detention center, even if state funds were used.

Abudu’s dissent highlighted the inherent reliance on federal involvement, stating the facility “would not, and could not, have been built and used as an immigration detention center without the federal defendants’ request.” Immigration, she asserted, remains “uniquely and exclusively within the federal government’s domain.”

Located at the Dade-Collier Training and Transition Airport, “Alligator Alcatraz” is surrounded by fragile, protected wetlands within the heart of the Everglades ecosystem. Environmental groups argue the facility was rushed into existence without proper environmental review, inflicting significant damage.

Friends of the Everglades and the Center for Biological Diversity, the groups who initially brought the lawsuit, vow to continue the fight, sending the case back to the original district court for further review. They maintain the construction caused immense “human and ecological cost.”

The legal struggle unfolds against a backdrop of disturbing allegations concerning conditions inside the detention center. A recent court declaration from a lawyer representing detained migrants details accusations of severe abuse by guards.

The declaration alleges guards brutally beat and pepper-sprayed detainees, resulting in injuries to heads, shoulders, and wrists. One detained individual reportedly suffered a broken wrist during the incident, painting a grim picture of life within the facility’s walls.

This isn’t an isolated case; Florida officials also constructed a second immigration detention center in the northern part of the state, raising broader questions about oversight and accountability within the state’s immigration detention system. The future of both facilities, and the rights of those held within them, remain uncertain.
