The old adage – “the road to hell is paved with good intentions” – echoes with unsettling resonance in the case of Constable Mike Kiproff. A 33-year veteran of the Toronto Police, Kiproff now faces a grueling inquiry, a process that feels less like a pursuit of justice and more like a calculated dismantling of a career.

What began as a seemingly simple traffic incident on the QEW has spiraled into a protracted legal battle. Initially facing seventeen charges under the Police Act, the accusations have been systematically reduced, now resting on a fragile foundation of just four. The prosecution itself appears hesitant, leaving the impression that the driving force behind this inquisition originates not from a desire for accountability, but from within the police hierarchy itself.

On a January afternoon three years ago, Kiproff was en route to work when a vehicle aggressively tailgated his BMW, coming within inches of a collision. He testified, describing the experience as terrifying, fearing a catastrophic impact, especially with vulnerable drivers nearby. A quick tap of the brakes was his instinctive reaction, a desperate attempt to avoid a potential tragedy.

The driver, later identified as Cole Schneider, responded with a barrage of obscenities, accusing Kiproff of “brake-checking” him. When Kiproff identified himself as a police officer, Schneider’s demeanor shifted, a flicker of apprehension crossing his face. The officer, concerned about the reckless driving, followed to obtain the vehicle’s license plate.

The situation escalated when Kiproff contacted Schneider’s home, only to be met with a furious tirade from the driver’s father. The elder Schneider unleashed a torrent of abuse, laced with profanity and a visceral hatred for law enforcement. The verbal assault ceased only when Kiproff’s body-worn camera activated, signaling the recording of the interaction.

Instead of immediately issuing a charge, Kiproff exercised discretion. He requested that Schneider and his father come to the station, hoping to understand the circumstances and potentially offer a lesser penalty – a stunt driving charge rather than a more serious dangerous driving offense. He sought dialogue, a chance to de-escalate the situation and perhaps avoid further legal repercussions.

This attempt at reasoned judgment became the crux of the accusations against Kiproff. The Toronto Police Association lawyer, Peter Brauti, argued that a less experienced officer might have simply laid charges and moved on. But Kiproff, a seasoned veteran, chose a different path, one rooted in experience and a desire to understand the full picture.

The investigation revealed Schneider had a recent history of domestic disturbance, a charge later dismissed. Activist lawyer Selwyn Peters became involved, sending a letter to Kiproff that Brauti characterized as “threatening.” The police alleged Kiproff’s actions were retaliatory, a claim undermined by the fact that he had informed his superior officer of his intentions beforehand.

Brauti, in his closing statements, powerfully articulated the irony of the situation. He suggested that Kiproff was being punished for attempting to do the right thing, for extending a measure of understanding. “It seems that no good deed goes unpunished,” he stated, a sentiment that resonated with the gravity of the case.

This isn’t the first time Kiproff’s dedication has been questioned. In a separate incident, he aggressively pursued security footage from the Centre for Addiction and Mental Health following a sexual assault, fearing it would be erased. While hailed as a hero by the victim and her mother, his actions were deemed to not fully meet expectations, resulting in a compromise.

Superintendent Shane Branton has reserved judgment, and his findings will be released at a later date. The outcome remains uncertain, but the case of Constable Kiproff serves as a stark reminder of the precarious position faced by officers who dare to exercise judgment and compassion in a system often prioritizing strict adherence to protocol.
