A former New York City Council staffer is facing deportation after an immigration judge ruled against him, a case that has ignited a fierce debate over immigration policy and sanctuary city practices.
Rafael Andres Rubio Bohorquez, 53, worked as a data analyst for the City Council. He was initially detained by Immigration and Customs Enforcement (ICE) during what he believed was a routine immigration check-up in January.
Federal authorities quickly determined Rubio Bohorquez had overstayed his tourist visa, entering the country in 2017 with a departure date of October 22nd of that same year. He had been living in the United States without legal authorization ever since.
The Department of Homeland Security (DHS) identified Rubio Bohorquez as a “criminal illegal alien,” citing a prior arrest for assault in New York City. This detail immediately complicated the narrative surrounding his case.
The revelation of his arrest and immigration status sparked outrage from some, who pointed to the situation as a stark example of potential vulnerabilities within sanctuary city policies. Concerns were raised about the employment of someone without proper work authorization by a government body.
However, New York City Democrats swiftly defended Rubio Bohorquez, asserting he was a law-abiding employee who had successfully passed background checks and was authorized to work. They directly contested DHS’s claims regarding his criminal record.
City Council Speaker Julie Menin announced the judge’s deportation order on Wednesday, expressing outrage and vowing to pursue every possible legal avenue to fight the decision. She emphasized that Rubio Bohorquez had been compliant with immigration procedures.
Menin argued the ruling hinged on a procedural issue related to his asylum application, suggesting a technicality could unjustly determine his fate. She maintained he posed no threat to anyone and should be released pending appeal.
