Garcia had been indicted by a federal grand jury in Tennessee on charges of transporting undocumented migrants within the United States, with allegations of conspiracy to transport aliens and unlawful transportation of undocumented aliens. The indictment claimed Garcia and co-conspirators from El Salvador, Guatemala, Mexico, and the US were trafficking illegal aliens from 2016 through 2025.

In a stunning move, Judge Waverly Crenshaw, an Obama appointee, granted Garcia's motion to dismiss the human trafficking case, citing vindictive and selective prosecution in violation of the Fifth Amendment's Due Process Clause. The judge's scathing criticism of the Trump Administration's handling of the case only added to the controversy.
