A growing concern is brewing over the preparedness of New York’s election system, with accusations that critical safeguards are being ignored as the nation approaches pivotal midterm elections. An election integrity organization warns the state is failing to address known vulnerabilities, potentially undermining public trust in the process.

Restoring Integrity and Trust in Elections (RITE), a nonpartisan group dedicated to election security, claims the New York State Board of Elections (NYSBOE) has actively resisted efforts to correct flaws in its voter registration process. Their concerns center on compliance with federal voting law, specifically the Help America Vote Act (HAVA).

Late last year, RITE formally notified the NYSBOE of several violations, outlining how these issues could compromise the integrity of upcoming elections. Despite this warning, the board allegedly failed to rectify the majority of the identified problems, prompting a demand for comprehensive records to uncover the full extent of the system’s shortcomings.

A central issue lies within the state’s voter registration form itself. New York allegedly isn’t requiring applicants to provide driver’s license information when available, a direct violation of HAVA. Furthermore, the state continues to accept registrations lacking essential identifying details – a driver’s license, the last four digits of a Social Security number, or a sworn statement confirming neither is held.

This lax approach has resulted in millions of New York voters submitting incomplete registration information. The consequence? A significantly more challenging task for the state to maintain accurate and reliable voter lists, raising questions about the validity of the rolls.

RITE and Representative Claudia Tenney are demanding action, setting a deadline for the NYSBOE to address these concerns. Failure to comply, they state, will lead to legal action, seeking a court order to enforce federal law and ensure a secure election process.

The problem isn’t simply a matter of incomplete forms. RITE alleges the board refused a requested audit to determine the sheer number of flawed applications already processed, hindering efforts to understand the scale of the issue and implement effective corrections.

Data from a 2022 report reveals the potential magnitude of the problem, indicating that at least 3.1 million New York registered voters have not provided either a driver’s license or Social Security number on their registration forms. This raises serious questions about the accuracy and reliability of the state’s voter database.

“The law is clear: states may not accept registration forms that lack required identifying information,” emphasizes RITE President Justin Riemer. “New York’s own regulations reinforce this. This blatant disregard for a crucial federal safeguard erodes the integrity of the entire voter registration system.”

Representative Tenney, chair of the Election Integrity Caucus, has been vocal about her concerns since 2022, repeatedly calling for a thorough investigation into the NYSBOE’s practices. She stresses that transparency and accurate voter rolls are paramount to maintaining public confidence in elections.

Concerns extend beyond the state level. The New York City Board of Elections has also faced scrutiny, with recent video footage revealing an employee failed to prevent a reporter posing as a noncitizen from attempting to register to vote, highlighting further vulnerabilities in the system.
