The indictment against former FBI Director James Comey isn't based solely on a single Instagram post, according to Acting Attorney General Todd Blanche. He asserted that a substantial body of evidence, gathered over eleven months, will be presented in court to support the government’s claim of a criminal threat against the former president.

The core of the case rests on proving intent – a critical legal hurdle for prosecutors. Blanche emphasized that intent isn’t established by a single piece of evidence, but through a comprehensive collection of witness testimony and documentary materials. He directly refuted suggestions that the prosecution was motivated by past conflicts between Trump and Comey.

The controversy centers around an Instagram post featuring seashells, accompanied by the numbers "8647." Prosecutors interpret "86" as slang for eliminating someone, and "47" as a reference to Donald Trump as the 47th president, thus alleging a veiled threat. However, Blanche pointed out that the Department of Justice doesn’t pursue charges based on casual use of the phrase, citing examples of related merchandise available for sale.

Blanche underscored the thoroughness of the investigation, involving career professionals from the U.S. Attorney’s Office, the FBI, and the Secret Service. He refrained from detailing the specifics presented to the grand jury, but insisted the indictment wasn’t solely based on the Instagram post itself. A deeper investigation revealed compelling reasons for the charges.

The Department of Justice has charged Comey with two counts in federal court in North Carolina, alleging the Instagram post constituted a threat to harm or kill the former president. The post quickly ignited outrage on social media, with many accusing Comey of making a direct threat against his longtime political opponent.

Comey swiftly deleted the image and issued an apology, stating he hadn’t realized the number "86" carried violent connotations. This followed an initial investigation by the Secret Service, prompted by then-Department of Homeland Security Secretary Kristi Noem, where Comey voluntarily cooperated with federal agents. No charges were filed at that time.

This indictment marks the second time the Justice Department has pursued charges against Comey. A previous indictment alleging he lied to Congress was dismissed on procedural grounds, a decision the DOJ is currently appealing. The timing of the current charges has drawn scrutiny, particularly in light of Trump’s public calls for prosecution.

Blanche addressed concerns about Trump’s Truth Social posts demanding action against his political adversaries, maintaining that the investigations were already underway. He argued that the charges weren’t a direct response to Trump’s demands, but the result of independent, ongoing investigations.

The charges have sparked widespread debate, with critics arguing they represent a free speech issue and fail to meet the Supreme Court’s “true threat” standard. Comey’s legal team intends to seek dismissal of the charges, alleging selective and vindictive prosecution. Despite the criticism, the DOJ and Trump’s allies remain steadfast in their defense of the indictment.

Comey is scheduled to be arraigned on May 11 in Greenville, North Carolina. The case promises a complex legal battle, with the government poised to present its full case and Comey’s defense prepared to challenge the charges on multiple fronts.
