
A former teacher and cheerleading coach in California who allegedly sent underage girls a video of his genitals claims the text was an accident and intended for a sex worker.
Nicholas Moseby, 43, who was arrested in September 2022, is on trial over accusations that he texted the naked video to two girls, aged 14 and 15. Moseby’s public defender Manisha Daryani told a Contra Costa County courtroom: “He talks to a lot of sex workers,” theEast Bay Timesreported.
“All of us have phones and all of us have accidentally texted the wrong person,” the attorney added. “It happens.”
However, since Moseby’s 2022 arrest, more alleged victims have come forward against the ex-teacher.
Moseby was initially charged with three felonies: Two counts of committing a lewd act upon a child and another count for distributing or showing pornography to a minor, according tothe Contra Costa County District Attorney’s Office.
The former educator was further accused of groping, grinding on and making lewd comments toward other alleged victims who have stepped forward since the first accusations, according to the outlet. He now faces an addition charge of sexual battery.
Moseby was a biology teacher at San Ramon Valley High School in Danville, Calif., before working as a gym teacher at Diablo Vista Middle School in the same town. He also served as a cheer instructor at Nor Cal Elites in nearby San Ramon.
Moseby was in custody until he posted $200,000 bail in December 2022.

NUMEROUS DELAYS
The trial was initially scheduled for November 2023, but was postponed eight times for numerous reasons including requests for more time from his lawyers and prosecutors from the district attorney’s office, theDanville San Ramonreported.
The ex-teacher pleaded not guilty to the charges.
Moseby was sued by the alleged victims last November in a civil lawsuit that names the school district, several former administrators and Nor Cal Elite. He has filed a cross-complaint in that case, again denying the allegations and alleging the plaintiffs and their classmates have engaged in a co-ordinated effort to target and harass him due to personal biases against him.
Deliberations in Moseby’s criminal trial began Tuesday.
