Florida’s governor has launched a sweeping directive aimed at reshaping hiring practices within the state’s university system, declaring an end to what he terms “H-1B visa abuse.” The order mandates the Florida Board of Governors to actively curtail the practice of bringing in foreign workers on these visas. The core of the issue, as presented, centers on the belief that qualified American citizens are being overlooked in favor of cheaper, foreign labor. The governor contends that universities are prioritizing H-1B visa holders instead of graduates emerging from Florida’s own institutions. This, he argues, undermines the purpose of a state-funded higher education system. The governor’s office asserts that taxpayer dollars should prioritize the American workforce, not serve as a means to import labor at reduced costs. The focus is shifting towards ensuring Florida’s universities actively cultivate and employ the talent produced within the state’s borders. H-1B visas are officially intended for specialized occupations requiring advanced knowledge – roles that supposedly cannot be filled by the existing American workforce. However, concerns are rising that these visas are being utilized for positions that could readily be occupied by qualified U.S. citizens. Universities, uniquely, are exempt from federal H-1B caps, allowing for continuous recruitment of foreign workers. The Department of Labor defines a “specialty occupation” as one demanding a bachelor’s degree or equivalent, and a high level of specialized expertise. The program’s original intent was to bridge gaps in skills unavailable domestically, offering temporary employment to qualified individuals. During a recent press conference, the governor highlighted a specific example discovered within the university system: an assistant swim coach hired from Spain. He questioned the necessity of looking abroad for such a position, given the potential for qualified American candidates. This action follows a recent call to action from the Department of Justice, urging citizens to report potentially illegal visa practices that disadvantage American workers. The DOJ is specifically seeking reports of job advertisements that demonstrate a preference for H-1B or seasonal visa holders. The Department of Justice is also accepting tips related to potential human trafficking violations connected to temporary visa programs, broadening the scope of the investigation beyond simple employment discrimination. The aim is to protect both American workers and ensure fair treatment of those entering the country on temporary visas.
