This wasn’t a routine inquiry; it was a deep dive into the personal communications of a leading political figure, raising serious questions about the scope and intent of the January 6th investigation.

The alleged pursuit didn’t stop with the Speaker. Representative Louie Gohmert, a staunch conservative voice, also found himself under scrutiny, his private phone records similarly sought by Smith’s team. These actions, recently revealed through a document shared with Senators Chuck Grassley and Ron Johnson, paint a picture of an investigation reaching far beyond the immediate events of that January day.

The document details a request, dated January 24, 2023, for the “toll records” of both McCarthy and Gohmert’s personal cellphones. This wasn’t a casual request; it was a formal attempt to access deeply personal information, raising concerns about the potential for political targeting and abuse of power.

Former Speaker McCarthy reacted with outrage, calling Smith’s investigation a “blatant weaponizing of the Justice Department.” He believes the attempt to access the phone records of sitting members of Congress, including the Speaker himself, underscores a disturbing pattern of politically motivated attacks.

McCarthy vowed to demand accountability, promising congressional hearings and a thorough investigation into Smith’s actions. He also intends to explore all legal avenues to prevent such overreach from happening again, safeguarding the privacy of elected officials.

This revelation isn’t isolated. Reports surfaced earlier that Smith’s “Arctic Frost” team was tracking the communications of nearly a dozen Republican senators, including prominent figures like Lindsey Graham and Ted Cruz. The investigation appeared to be casting a wide net, collecting data from major telephone providers.

While Smith defended the subpoenas as “entirely proper” and consistent with Justice Department policy, the sheer scale of the data collection raises eyebrows. The focus was reportedly limited to a four-day period surrounding January 6th, but the breadth of the targeting remains deeply concerning.

AT&T, responding to inquiries from Senator Grassley, confirmed receiving a grand jury subpoena requesting records for two members of Congress. While they identified Senator Cruz as one, they initially refused to name the other, adding another layer of mystery to the unfolding events.

The newly revealed document now clarifies that the second target was indeed Speaker McCarthy. However, AT&T pushed back, questioning the legal basis for seeking the records of members of Congress, ultimately leading Smith’s office to withdraw the subpoena without obtaining the data.

Senator Grassley described “Arctic Frost” as a “fishing expedition” that indiscriminately swept up Republicans, both inside and outside of Congress. The investigation, launched in April 2022 and later taken over by Smith, appears to have operated with a level of intensity that prompted internal concerns within the FBI.

The FBI itself classified “Arctic Frost” as a “prohibited case,” requiring heightened transparency and oversight. This designation suggests the investigation was considered particularly sensitive and potentially prone to abuse, yet the pursuit of congressional phone records continued.

The unfolding story raises fundamental questions about the balance between legitimate investigation and political overreach. As Congress prepares to investigate Smith’s actions, the nation watches, seeking answers and demanding accountability for what many see as a dangerous precedent.

The case, initially focused on the events of January 6th, took an unexpected turn when Smith sought to dismiss charges against President Trump after his election, a move granted by Judge Tanya Chutkan. This adds another layer of complexity to a narrative already fraught with political tension and legal scrutiny.
