The legal battle surrounding former FBI Director James Comey took a dramatic turn Thursday as a Clinton-appointed judge openly questioned the legitimacy of the US Attorney prosecuting his case. Judge Cameron Currie, presiding over the proceedings, voiced skepticism regarding the appointment of Lindsey Halligan, casting a shadow over the validity of the indictment against Comey.
Comey is facing serious charges – two counts of false statements and obstruction of a congressional proceeding – potentially carrying a five-year prison sentence. He’s aggressively challenging the case, alleging “vindictive prosecution” and directly targeting the authority of the prosecutor, Halligan, in a bold legal maneuver.
The core of Comey’s defense rests on the claim that Halligan’s appointment as Interim US Attorney for the Eastern District of Virginia was improper. He pointed to precedent, arguing the circumstances surrounding her initial designation were legally insufficient to grant her the power to pursue the charges against him.
In a swift response to Comey’s challenge, former Attorney General Pam Bondi acted decisively. She retroactively created a new position for Halligan – “special attorney” – effectively bolstering the legal foundation of her appointment and attempting to neutralize Comey’s claims.
Bondi’s order, dated October 31st, explicitly invoked her authority under federal law to designate Halligan as US Attorney, dating the appointment back to September 22nd. Further solidifying the move, Bondi also appointed Halligan as a “special attorney” from the same date, ratifying her standing within the Department of Justice.
This designation of “special attorney” grants Halligan full authority to conduct any legal proceeding – civil or criminal – within the Eastern District of Virginia, including grand jury proceedings and appearances before judges and magistrates. Bondi’s actions were clearly intended to preemptively validate Halligan’s role in the prosecution.
However, Judge Currie’s pointed questions during Thursday’s hearing suggest Bondi’s efforts may not be enough. The judge’s expressed doubts signal a potential willingness to side with Comey, potentially leading to the dismissal of the charges against him and even against Letitia James, who is also facing scrutiny in the case.
The stakes are incredibly high, with the future of the case – and potentially Comey’s freedom – hanging in the balance. Judge Currie has indicated she will deliver her ruling before Thanksgiving, leaving both sides bracing for a pivotal decision that could reshape the legal landscape of this high-profile prosecution.
