A multimillionaire’s decade-long battle with a betting platform has reached its end. Lee Gibson, a man defined by a relentless gambling habit, has lost his appeal against Betfair, seeking to recover nearly £1.5 million lost over ten years.

Gibson argued Betfair had a responsibility to protect him from his own destructive tendencies, claiming they were fully aware of the harm his gambling was causing. He believed the platform should have intervened, preventing him from spiraling into massive debt.

Between 2009 and 2019, Gibson relentlessly placed over 30,000 individual bets with Betfair. Despite owning a substantial property portfolio generating significant rental income, he pursued the claim for approximately £1 million in losses.

The case initially landed before Judge Nigel Bird in the UK High Court earlier in 2024, who swiftly dismissed Gibson’s claims. Undeterred, Gibson appealed the decision, hoping for a different outcome.

The appeal, heard on December 8th, rested on five key arguments. These challenged the court’s findings regarding breaches of licensing conditions, duty of care, negligence, causation, and the validity of gambling contracts entered into under compromised circumstances.

The Court of Appeal meticulously examined each point, ultimately upholding the original ruling. The judgment stated the initial judge “considered the relevant evidence, made no errors of principle…and came to an entirely reasonable conclusion.”

Crucially, the court found no evidence to suggest Betfair should have recognized Gibson as a “problem gambler.” This determination effectively sealed the fate of his appeal, leaving him with the full weight of his losses.

The detailed court document emphasized that Betfair acted reasonably, given the information available to them. It underscored the difficulty in assigning responsibility for an individual’s choices, even when those choices are demonstrably harmful.

This case, widely followed in legal circles, represents a significant precedent regarding the responsibilities of gambling platforms. It highlights the delicate balance between protecting vulnerable individuals and respecting personal autonomy.
