A hefty €400,000 fine has been levied against JOI Gaming Limited by the Dutch gaming regulator, the Kansspelautoriteit (Ksa), stemming from concerns over their advertising practices. The core issue? The alleged exploitation of influential figures to promote their JACK’s Racing Day offerings. This action underscores the Netherlands’ firm stance against leveraging public personalities in the realm of online gambling.

JOI Gaming, operating under a license granted in 2021, provides both casino games and sports betting services within the Dutch legal framework. Despite holding a valid license, the Ksa determined that the company’s promotional campaign for JACK’s Racing Day – a major European motorsport event – crossed a critical line. The regulator’s investigation revealed a pattern of utilizing recognizable faces to attract players.

Specifically, the Ksa cited instances of prominent individuals signing merchandise bearing the JACK’S logo and appearing in promotional photographs alongside brand representatives. These images were widely disseminated across JACK’S Racing Day’s website and social media platforms, creating a direct association between admired figures and the gambling brand. This practice immediately triggered the Netherlands’ strict advertising regulations.

Dutch law explicitly prohibits the use of “role models” – defined as celebrities, athletes, or influencers – in the advertising of high-risk games of chance like online gambling. The reasoning is clear: these individuals often embody success and aspirational lifestyles, potentially influencing vulnerable young adults to engage in risky behavior. Lower-risk games, such as lotteries, are subject to stricter, but less prohibitive, guidelines.

This isn’t the first warning JOI Gaming received. The Ksa had previously issued a penalty notice demanding the immediate removal of the offending social media posts, a request the company swiftly addressed. However, the full extent of the fine was delayed due to a legal challenge initiated by JOI Gaming, seeking an interim injunction. The court partially sided with the company, leading to the recent public announcement of the €400,000 penalty.

The Ksa’s decisive action sends a powerful message to all operators licensed within the Netherlands. It reinforces the commitment to protecting vulnerable individuals and maintaining the integrity of the gaming market. The use of influential figures to normalize or glamorize gambling will not be tolerated, and those who attempt to circumvent the rules will face significant consequences.
