This ongoing financial tie, they argue, necessitated her recusal from any decisions regarding Mangione’s case, a step they contend she failed to take.

According to the filings, Bondi’s actions represent a clear violation of Mangione’s due process rights. Her public pronouncements, including a press release and national television appearances, allegedly pre-judged his guilt and demanded execution even before formal indictment.

The defense paints a stark picture: Bondi, having left Ballard Partners to become Attorney General, immediately targeted the alleged killer of her former client for the ultimate punishment. This timing, they argue, is not coincidental but indicative of a biased pursuit of the death penalty.

The alleged crime itself is chilling. Brian Thompson was fatally shot in an execution-style killing outside a Manhattan hotel in December 2024, the scene captured on camera. Prosecutors believe Mangione acted on financial and corporate grievances, meticulously planning the assassination.

Mangione’s capture followed a brief flight from the scene, but this is not the first challenge to the death penalty in his case. Previous arguments centered on whether the underlying stalking charge legally qualified for capital punishment.

Earlier attempts to block the death penalty focused on accusations of political motivation and prejudicial statements, but the current filings hone in on the alleged financial conflict as the most compelling reason to strike the death penalty notice. The defense insists Bondi’s initial stance “cannot be unrung.”
