A family is seeking answers and accountability following the tragic death of their 19-year-old daughter, Brianna Aguilera, a student at Texas A&M University. The lawsuit, filed in Travis County, alleges that reckless over-service of alcohol contributed directly to the circumstances surrounding her fall from an Austin high-rise apartment in late November.

The legal action targets two organizations: the Austin Blacks Rugby Club and the UT Economics and Business Association. Attorney Tony Buzbee announced the $1 million wrongful death suit, asserting that providing alcohol to minors is not only illegal in Texas but also demonstrated a profound disregard for the safety of young people.

The events unfolded after a heated Texas A&M versus University of Texas football tailgate. Witnesses reportedly observed Aguilera’s condition deteriorate over several hours, transitioning from cheerful to confused and ultimately to a state of severe intoxication, according to the lawsuit.

Police responded to a call around 1 a.m. on November 29th, discovering Aguilera had fallen from the apartment building. While authorities initially classified the death as a suicide, Aguilera’s family vehemently disputes this finding, believing the excessive alcohol consumption played a critical role.

The lawsuit details allegations of “egregious over-serving of minors,” painting a picture of a gathering where responsible alcohol service was abandoned. The family contends that this negligence created a dangerous environment that ultimately led to their daughter’s death.

Beyond seeking financial compensation, the lawsuit aims to bolster the ongoing police investigation. Buzbee stated the legal proceedings will allow his firm to subpoena crucial evidence, including phone records, text messages, and compel testimony from those present that night.

The family is requesting a jury trial, determined to present their case and seek justice for Brianna. They hope to uncover the full truth surrounding the events of that night and hold those responsible accountable for their actions.
