They’ve chosen a path of outright defiance, rejecting lawful subpoenas issued by the House Oversight Committee.

The committee, investigating the complexities surrounding Jeffrey Epstein, sought the Clintons’ testimony. Crucially, neither politician has been accused of any criminal wrongdoing in this matter. Yet, instead of complying, the Clintons delivered a pointed letter, a declaration of resistance framed as patriotic duty.

Their statement asserted a breaking point, a moment to “fight for this country,” regardless of the repercussions. The committee appears poised to accept that challenge, initiating contempt proceedings as a direct consequence of this refusal. The initial deposition date for former President Clinton was set, then postponed twice – once to accommodate a funeral.

Despite these accommodations, the Clintons’ legal counsel ultimately declined to propose alternative dates. This decision came after a surprisingly bipartisan vote to issue the subpoenas in the first place, with even some Democratic members acknowledging the necessity of compliance. The situation highlights a shift in how congressional requests are viewed.

Arguments that the testimony is “unnecessary” or a “distraction” hold no weight in the face of a lawfully issued subpoena. The Clintons’ stance echoes a recent pattern of defiance, mirroring the approach taken by Hunter Biden, who opted for a public statement outside of Congress rather than a formal deposition.

This reversal is particularly striking given past rhetoric. President Biden himself once insisted that defying subpoenas is unacceptable, demanding accountability for those who refused to cooperate with the January 6th investigation. Individuals like Steven Bannon and Peter Navarro faced swift contempt citations for similar actions.

At that time, such defiance was unequivocally condemned. Now, figures like Representative Dan Goldman frame it as righteous, prioritizing political allegiance over institutional integrity. This double standard could lead to criminal referrals for the Clintons, mirroring prosecutions pursued under the current administration.

The irony is palpable. Hillary Clinton once openly mocked Bannon’s indictment for contempt, anticipating a “restful” weekend while he faced potential conviction. Now, the Clintons are employing the very strategy that landed Bannon in legal jeopardy. A simple appearance, even with invocation of the Fifth Amendment, would have shifted the burden to the committee.

Instead, the Clintons chose complete non-compliance, a move that leaves them with little legal ground to stand on. It’s a gamble predicated on a perceived immunity, a belief that established rules simply don’t apply to them. This defiance feels less like a calculated legal strategy and more like a declaration of privilege.

The Clintons’ approach recalls Bill Clinton’s response during the Lewinsky scandal, a plea to move beyond the “spectacle” and focus on national priorities. That tactic, despite a finding of perjury, proved surprisingly effective. However, this case isn’t about semantics; it’s about the fundamental obligation to testify when summoned.

It’s difficult to argue against contempt when defiance *is* the defense. The Clintons, with decades of navigating legal challenges, may not be losing sleep over this. But their actions represent a stark example of a two-tiered justice system, a system where some believe themselves above the law.
