The former superintendent of Des Moines Public Schools, Ian Roberts, is poised to admit guilt to federal charges stemming from his arrest last year by U.S. Immigration and Customs Enforcement. Roberts, a native of Guyana, once led Iowa’s largest school district before his sudden resignation following his detainment on September 26th.

Initially, Roberts pleaded not guilty to charges of making a false statement for employment and unlawful possession of a firearm while in the country illegally. These charges collectively carry a potential sentence of up to two decades behind bars, a stark consequence for the former educator.

A signed plea agreement reveals a shift in Roberts’ legal strategy; he now intends to plead guilty to both counts. The agreement also acknowledges the strong possibility of deportation following the completion of any prison sentence.

Authorities allege Roberts has a significant criminal history, including prior offenses related to drugs and weapons. Homeland Security officials emphasized the danger he posed, stating a person with such a background should not have been entrusted with the safety of children.

At the time of his arrest, Roberts was found in possession of an illegal handgun, a hunting knife, and nearly $3,000 in cash. This discovery fueled concerns about his past and the circumstances surrounding his employment.

The case centers on a knowingly false claim made by Roberts on an Employment Eligibility Verification form – the I-9 form – where he asserted his U.S. citizenship. Providing false information on this document carries a potential five-year prison sentence and a substantial fine.

Roberts submitted a Social Security card and driver’s license as verification when hired in 2023, and further affirmed his citizenship in his application for a professional administrator license. These documents formed the basis of his employment eligibility.

However, records show Roberts was previously ordered to appear before an immigration judge in 2020, with a final removal order issued in 2024. School district officials claim they were unaware of these ongoing immigration issues.

His legal counsel has stated Roberts believed a previous attorney had successfully resolved his immigration case, a claim that now appears to be inaccurate. The unfolding situation highlights a potential failure in vetting procedures.

Beyond the false statement charge, Roberts faces a separate federal weapons charge, punishable by up to 15 years in prison. Investigators discovered two pistols, a rifle, and a shotgun in his possession – one in his vehicle and three more during a search of his home.

As part of the plea agreement, Roberts will be required to forfeit all the firearms found in his possession. This represents a significant concession and a step towards accountability for the charges against him.

The case raises serious questions about background checks and the potential for individuals with concealed criminal histories to occupy positions of public trust, particularly within the education system.
