A legal battle is brewing in Alabama, centered around the controversial platform Kalshi and its foray into what plaintiffs allege is illegal sports wagering. The state, known for its staunch opposition to gambling, has become a focal point in a growing national debate over the boundaries of financial markets and betting.

Alabama’s laws are exceptionally strict, effectively outlawing most forms of gambling. Kalshi, however, operates through event-based contracts framed as trading activity, a subtle distinction that allows it to navigate under federal commodities regulations overseen by the CFTC – rather than state gambling authorities.

This legal maneuvering hasn’t gone unnoticed. A class action lawsuit has now been filed in Alabama federal court, marking the first of its kind against a prediction market platform within the state. It arrives amidst a surge of legal challenges, with over 40 prior lawsuits targeting sweepstakes casinos in Alabama alone.

Just as the lawsuit gained momentum, a surprising development emerged. The Chairman of the CFTC, Michael S. Selig, signaled the agency’s intent to actively assist these markets with legal defense, potentially shifting the landscape of the case dramatically.

The Coalition for Prediction Markets has hailed the CFTC’s stance as a crucial lifeline. This intervention could provide Kalshi with the federal backing needed to counter the Alabama lawsuit, arguing that its operations fall within the purview of commodities trading, not prohibited gambling.

Kalshi isn’t alone in facing scrutiny. The company has increasingly drawn fire as it expands its reach into sports-related contracts, effectively sidestepping traditional gambling restrictions in heavily regulated states. This strategy has raised concerns about the blurring lines between legitimate financial instruments and illicit betting.

Washington state recently banned prediction markets altogether, echoing similar anxieties. Nevada has also taken action, revoking licenses from major players like DraftKings and Flutter Entertainment as they ventured further into prediction market territory.

Alabama’s crackdown on gambling has been particularly aggressive in recent times, with numerous arrests made throughout 2025 related to illegal machines and practices. The future of prediction markets within the state now hangs in the balance, dependent on whether the CFTC’s support can withstand the legal challenge.

The unfolding situation represents a pivotal moment for the prediction market industry, testing the limits of regulatory oversight and potentially reshaping the future of sports-related financial trading across the nation.
