The man convicted of the brutal murder of Laken Riley, a 22-year-old nursing student, pressed for a new trial Friday, but a judge reserved judgment after hearing arguments from both sides. Jose Ibarra, already facing a life sentence without parole, appeared in court as his attorneys attempted to cast doubt on the evidence that led to his conviction.

Judge Patrick Haggard listened intently as Ibarra’s legal team presented their case, focusing on potential errors during the original trial. A key element of their argument centered on Ibarra’s mental state, but the judge revealed a recent court-ordered evaluation found him competent both at the time of the crime and throughout the proceedings.

A forensic expert, Dr. Ruth Ballard, took the stand for the defense, meticulously examining the physical evidence presented to the jury. Her testimony highlighted a puzzling detail: bloodstained gloves found near Ibarra’s residence contained Riley’s DNA, along with DNA from an unidentified individual, but crucially, not Ibarra’s own.

Further complicating the picture, Dr. Ballard testified that no male DNA was discovered on the sexual assault evidence kit. The defense suggested alternative scenarios, even hinting at the possibility of another individual being responsible for Riley’s death.

However, the prosecution swiftly countered these claims. Sheila Ross, the prosecutor, challenged the suggestion that Ibarra’s brother, Diego, could have committed the crime. DNA testing under Riley’s fingernails, initially inconclusive, was presented as definitively linking Jose Ibarra to the attack.

Y-STR testing initially pointed to either Jose or his brother Argenis, but more precise TRULEO testing unequivocally identified the DNA as belonging to Jose Ibarra, effectively excluding both of his brothers. This evidence strongly suggested a violent struggle, consistent with the attacker leaving DNA under Riley’s fingernails.

Dr. Ballard clarified that her analysis was limited to serology and DNA, excluding other crucial evidence like fingerprints, trace materials, and video footage. The prosecution emphasized the totality of the evidence, painting a clear picture of a brutal assault and struggle.

The tragic events unfolded on February 22, 2024, while Riley was running on the University of Georgia campus. Prosecutors detailed a violent confrontation that ultimately led to her death. She was a promising student at Augusta University’s College of Nursing, with a bright future ahead.

Ibarra’s legal team had previously sought a mental competency evaluation, arguing he was unfit to stand trial. Friday’s hearing specifically addressed whether alleged errors during the initial proceedings warranted a complete retrial. The judge has ordered both sides to submit further briefs by Monday, March 2nd, before making a decision.

Authorities have confirmed Ibarra entered the United States illegally in 2022 and was allowed to remain while his immigration case was processed. The case ignited a national conversation about border security and violent crime, becoming a focal point during recent political campaigns.

The Laken Riley Act, signed into law last year, now mandates the detention of unauthorized immigrants accused of violent crimes or theft. Ibarra remains incarcerated, serving his life sentence without the possibility of parole in a Georgia state prison, as the legal battle for a new trial continues.
