A decisive blow landed Friday as a federal judge dismantled significant parts of a presidential executive order intended to reshape voter registration and absentee ballot procedures. Judge Colleen Kollar-Kotelly asserted the White House dramatically exceeded its constitutional boundaries with the directive, effectively halting its implementation.

The core of the judge’s ruling centered on the fundamental principle of power distribution within the U.S. government. Kollar-Kotelly firmly stated that the Constitution reserves the authority to establish election rules for states and Congress – not the executive branch.

Specifically, the judge blocked provisions demanding documentary proof of American citizenship for both federal voter registration and absentee ballot requests. This requirement, the court determined, represented an overreach of presidential power and a direct infringement on constitutionally protected rights.

In a permanent injunction, Kollar-Kotelly explicitly forbade the administration from enacting the contested elements of the order, stating plainly: “The Constitution does not allow the President to impose unilateral changes to federal election procedures.” The ruling represents a significant check on executive authority in the realm of elections.

The executive order, formally titled “Preserving and Protecting the Integrity of American Elections,” was initially signed on March 25th. It sparked immediate legal challenges, arguing its potential to disenfranchise eligible voters and disrupt the electoral process.

The judge’s decision underscores the delicate balance of power within the American system, reaffirming that changes to federal election laws must originate from the legislative branch or through established constitutional amendment processes.
