A looming crisis threatens Illinois’s financial stability as the federal government scrutinizes its commercial driver’s licensing system. The U.S. Department of Transportation issued a stark warning to Governor JB Pritzker and state licensing officials, alleging widespread irregularities in the issuance of commercial licenses to non-citizens.

The core of the issue lies in a significant number of licenses granted to individuals who did not meet legal requirements. Transportation Secretary Sean Duffy revealed that approximately one in five commercial licenses issued to non-citizens were improperly granted, raising serious safety concerns about unqualified drivers operating large commercial vehicles.

Duffy’s ultimatum demands immediate action, citing cases of drivers from El Salvador, Ukraine, and other nations operating with invalid licenses. He emphasized a fundamental principle: state officials serve the American people, not those who have circumvented immigration laws and safety regulations.

The stakes are incredibly high. Over $128 million in federal highway funding, earmarked for Illinois through programs like the National Highway Performance Program, is now at risk. Furthermore, the state’s entire Commercial Driver’s License (CDL) program could face decertification if substantial noncompliance persists.

The problem centers on “non-domiciled” CDLs – licenses issued to non-citizens without permanent resident status. Exceptions exist for truckers from Mexico and Canada, whose licensing standards align with U.S. regulations. However, the audit uncovered licenses issued to individuals with expired work authorizations or incomplete documentation.

Specifically, the audit highlighted cases of drivers from Kyrgyzstan, Nigeria, and Moldova who presented expired or insufficient documentation. Even a driver from Singapore received a license with only partial paperwork, raising questions about the thoroughness of the vetting process.

The Department of Transportation requires verification of lawful presence in the U.S. before issuing these licenses. The audit revealed instances where Illinois officials accepted expired employment authorizations and pending applications as sufficient proof, a clear violation of federal guidelines.

Governor Pritzker and state officials have been ordered to immediately halt the issuance of all non-domiciled CDLs. They must identify and revoke noncompliant licenses, reissue valid ones, and conduct a comprehensive internal audit to address the systemic issues.

State Secretary of State Alexi Giannoulias responded to the warning, characterizing it as a “threat” to Illinois’s economy. He argued that disrupting the flow of goods would lead to supply chain failures, increased prices, and hardship for families.

Giannoulias maintains that Illinois’s CDL policies are largely compliant with federal regulations and has pledged to review the findings. However, concerns are mounting within the agricultural sector, which relies heavily on a consistent and legally sound trucking workforce.

The Illinois Agricultural Association has voiced concerns about the potential disruption caused by pausing the issuance of non-domiciled CDLs, emphasizing the critical role these drivers play in transporting essential goods and supporting the state’s agricultural economy.

This situation presents a complex challenge for Illinois, balancing economic needs with federal safety regulations and immigration laws. The coming weeks will be crucial as the state attempts to address the deficiencies identified by the Department of Transportation and secure its vital federal funding.
