A federal judge has taken the extraordinary step of fining a Justice Department attorney $500 each day until the government fully complies with a court order. The case centers on the detention of Rigoberto Soto Jimenez, a Mexican immigrant held by Immigration and Customs Enforcement (ICE).

Judge Laura Provinzino, appointed by President Biden, found Special Assistant U.S. Attorney Matthew Isihara in civil contempt of court. This severe penalty stems from repeated failures to adhere to the judge’s directives regarding Soto Jimenez’s release and the return of his personal belongings.

Soto Jimenez arrived in the United States in 2018 and has maintained a clean record, with no criminal history or deportation orders against him. His legal counsel asserts he has been diligently pursuing lawful immigration status for years, navigating a complex and often lengthy process.

The initial issue arose from Soto Jimenez’s arrest by ICE on January 14th. Judge Provinzino determined that his detention lacked a valid warrant, a critical legal justification. She also mandated a bond hearing, which was initially denied.

Following the judge’s order on February 9th, ICE did release Soto Jimenez by the imposed deadline of February 13th. However, the release was marred by a significant oversight: he was not returned his identification documents, a direct violation of the court’s instructions.

Isihara admitted in court that the judge’s order regarding the return of Soto Jimenez’s property had been overlooked, attributing the error to an overwhelming workload and insufficient staffing within the office. He described a situation where the demands of “Operation Metro Surge” had stretched resources to their breaking point.

Despite Isihara’s explanation, Judge Provinzino remained firm, stating that the volume of work was not an acceptable excuse for disregarding a court order. The daily fines began accruing the following day, and will continue until Soto Jimenez is fully reunited with his identification.

The judge’s actions underscore the importance of due process and the government’s obligation to uphold the law, even in complex immigration cases. The situation highlights the potential consequences of systemic pressures on legal professionals and the impact on individual liberties.
