The NCAA is intensifying its legal battle with Kalshi, a prediction market operator, focusing specifically on its use of the NCAA’s branding during the highly anticipated March Madness tournaments.

The core of the dispute lies in the NCAA’s claim that Kalshi is creating a false impression of an official partnership. The association argues that Kalshi’s use of NCAA trademarks and event branding suggests endorsement where none exists, potentially violating trademark law.

The NCAA has repeatedly demanded the removal of its trademarks from Kalshi’s platform, asserting that the continued use misrepresents any NCAA involvement. This isn’t a new issue; the association has been addressing concerns about Kalshi’s practices for months.

This latest clash builds upon growing tension between college sports leadership and the rapidly expanding prediction market industry. These markets allow users to trade contracts based on the outcomes of NCAA games, including the intense competition of March Madness.

Earlier this year, NCAA President Charlie Baker directly appealed to federal regulators, urging them to temporarily halt college sports prediction markets. He expressed serious concerns about the potential harm to student-athletes and the integrity of competitions.

Baker’s letter highlighted critical vulnerabilities, including inadequate age verification, questionable advertising tactics, and the risk of harassment or manipulation through insider information. He called for a “more robust system” with stronger safeguards before allowing these markets to continue.

A specific point of contention is language previously displayed on Kalshi’s platform stating “Outcome verified from NCAA,” with a direct link to the NCAA’s official website. The NCAA believes this phrasing strongly implies official verification of results.

The NCAA proposed a change to “Outcome sourced from NCAA.com” alongside prominent disclaimers clarifying that Kalshi is not affiliated with or endorsed by the NCAA. This distinction, they argue, is vital for protecting their brand and preventing consumer confusion.

Kalshi has acknowledged the concerns and stated they are reviewing their site language. However, the friction extends beyond simple wording adjustments.

Late last year, Kalshi attempted to launch contracts tied to individual athletes entering the NCAA transfer portal, a move that drew immediate and forceful criticism from college sports officials. The company subsequently paused those plans.

The broader legal debate centers on how prediction markets should be classified – as regulated financial exchanges or as forms of unregulated sports betting. This classification will determine which regulatory bodies have oversight.

Several states have already challenged specific contracts offered by Kalshi, adding another layer of complexity to the ongoing legal and regulatory landscape.
