The nation’s highest court has allowed a lawsuit against a major private prison company to move forward, a case alleging the exploitation of immigration detainees in Colorado. The Supreme Court’s decision doesn’t rule on the case’s core claims, but it removes a significant obstacle for those seeking justice.

At the heart of the dispute is the claim that detainees at a facility in Aurora were compelled to work for minimal or no pay. These jobs, including janitorial duties, were allegedly required to maintain basic living standards and even to supplement insufficient food rations.

Court documents reveal some detainees were paid as little as one dollar per day for their labor. The lawsuit, originally filed in 2014, paints a picture of systemic undercompensation and potential coercion within the detention center.

The company, GEO Group, argued it should be shielded from the lawsuit because it was simply following instructions from the federal government as a contractor. This claim of immunity was rejected by a federal judge, a decision GEO then appealed to the Supreme Court.

The Supreme Court’s unanimous ruling effectively denied GEO Group’s attempt to halt the legal proceedings. This means the case will now return to a lower court for further examination of the evidence and arguments presented.

GEO Group is a massive player in the private detention industry, controlling approximately 77,000 beds across nearly one hundred facilities nationwide. The company’s operations extend to immigration detention centers in multiple states, including a recently opened facility in New Jersey.

This Colorado case isn’t isolated. Similar legal challenges have emerged in other states, highlighting a pattern of concern regarding detainee labor practices. A previous case in Washington state resulted in a court ordering GEO to pay over $23 million for related issues.

While the Supreme Court’s decision doesn’t guarantee a victory for the plaintiffs, it represents a crucial step forward in their pursuit of accountability. The case will now proceed, offering a chance to fully investigate the allegations of exploitation and unfair labor practices.
