For businesses and individuals patiently awaiting tax refunds, a critical safeguard may be needed: an independent advocate to challenge the Bureau of Internal Revenue’s often sluggish reimbursement process. A former finance official recently highlighted the persistent delays plaguing micro, small, and medium enterprises seeking input VAT refunds, painting a picture of systemic inefficiency.

Cielo D. Magno, a former Finance Undersecretary, believes this inefficiency actively damages the BIR’s reputation. Her proposal? An independent tax advocate, empowered to provide unbiased opinions directly to the Department of Finance and legislators, assessing the fairness and effectiveness of the tax system’s administration.

The core of the problem, Magno explained, lies in the Philippines’ struggle to fully embrace digital revenue collection. Current systems are fragmented, relying on outdated IT infrastructure that hinders seamless data flow and creates vulnerabilities.

This fragmentation breeds discretion, and with discretion comes the potential for abuse and corruption. Siloed systems lack transparency, opening doors to questionable practices and eroding public trust in the fairness of tax collection.

Further complicating matters are significant gaps in digital identity verification. The incomplete integration of the national ID system, coupled with a lack of unified digital security, leads to account duplication and difficulties in accurately identifying taxpayers.

The potential benefits of a fully digitized tax system are substantial – estimated at around 4% of the nation’s gross domestic product. This represents a significant, untapped revenue stream achievable through improved digitalization and enhanced compliance.

Magno argues that a complete overhaul is necessary, advocating for the abolition of the BIR and its replacement with a new National Revenue Authority (NRA). This radical shift, she believes, is the only path to genuine digital transformation.

The proposal, originally outlined in House Bill 695 filed in 2017, envisions the NRA as a legally independent entity, shielded from political interference and governed by a board wielding independent authority. This structure aims to ensure impartial and efficient tax administration.
