A contentious legal battle is unfolding in Philadelphia, as five veteran police officers have filed a lawsuit alleging they were unfairly denied promotions due to their race and sex. Lieutenants Christopher Bloom, Kollin Berg, and Joseph Musumeci, alongside Sergeants Marc Monachello and LeRoy Ziegler Jr., are at the center of the dispute, claiming a city policy actively disadvantaged them.

The core of the lawsuit centers on the city’s “Rule of Five,” a promotion policy implemented in November 2025. This policy broadened the pool of candidates considered for supervisory positions, a shift from the previous “Rule of Two” which limited choices to the top two applicants. The plaintiffs argue this change wasn’t about merit, but about manipulating the demographics of the police force.

For decades, Philadelphia’s “Rule of Two” offered a straightforward path to promotion. The new “Rule of Five” grants appointing authorities greater discretion, ostensibly to increase diversity within the ranks. However, the lawsuit alleges this discretion was used to prioritize minority and female candidates, effectively sidelining qualified White male officers.

The city’s rationale for the change, as expressed by current Mayor Cherelle Parker when she was a City Council member, was to dismantle barriers preventing Black and Brown employees from advancement. The lawsuit contends this intention translates into unlawful discrimination, violating federal protections against race and sex-based bias.

America First Legal, the firm representing the officers, asserts the city, the Philadelphia Police Department, and senior law enforcement officials intentionally sought to reshape the racial and gender composition of the force to mirror the city’s overall demographics. This, they claim, was done regardless of individual qualifications or performance.

The legal team argues that no group should be discriminated against, and that the rights of these officers must be defended. They maintain that the “Rule of Five” is a clear violation of federal law, and that the city’s actions demonstrate a pattern of unconstitutional practices.

This isn’t the first time concerns have been raised about Philadelphia’s promotional practices. The Fraternal Order of Police Lodge #5 previously requested a Justice Department investigation, citing similar concerns about the “Rule of Five” and its impact on officer morale and retention.

The FOP expressed frustration that assurances of limited use of the policy were contradicted by the promotion results. They filed grievances on behalf of impacted members and are exploring all available remedies, including guidance from the Federal Department of Justice and Equal Employment Opportunity Commission regarding DEI practices.

Officers have reportedly voiced increasing complaints, believing they were passed over for less qualified candidates due to their race or gender. This growing discontent underscores the impact of the policy on the department’s internal climate and its ability to retain experienced personnel.

The lawsuit seeks a permanent injunction against the “Rule of Five,” prohibiting the consideration of race and sex in future hiring and promotion decisions. It also demands the retroactive promotion of the plaintiffs, along with full back pay and benefits lost due to the delayed advancements.

The Philadelphia Police Department has declined to comment on the ongoing litigation. The case promises a significant legal challenge, potentially reshaping the city’s approach to diversity initiatives and promotional practices within its police force.

The outcome of this lawsuit could have far-reaching implications, not only for the officers involved, but also for the broader debate surrounding diversity, equity, and inclusion policies in law enforcement and beyond.
