DUTERTE IMPEACHMENT: The Fight Isn't Over!

A pivotal moment unfolded Monday as a House committee determined the fate of impeachment complaints leveled against Vice-President Sara Duterte-Carpio. After a rigorous review, two of the four complaints were deemed sufficient in form, initiating a potentially significant chapter in Philippine politics.

The Justice committee’s initial task wasn’t to judge the merits of the accusations, but rather to ensure the complaints met basic procedural requirements – proper signatures and endorsements from lawmakers. This crucial first step narrowed the field, leaving only two complaints to proceed, according to committee chairman Batangas Rep. Gerville R. Luistro.

The complaints, originating from civil society groups, activists, and religious organizations, center on allegations of misused funds. Hundreds of millions of pesos in confidential and intelligence funds, allocated to the Office of the Vice-President and the Department of Education, are at the heart of the accusations.

One complaint, filed by left-leaning groups in early February, was swiftly dismissed. The Constitution prevents multiple impeachment attempts against the same official within a year, a rule that proved decisive in this case, with 22 congressmen voting for dismissal and 10 opposing.

This initial filing accused the Vice-President of not only misusing confidential funds but also of directing subordinates to falsify reports and deliberately avoiding crucial congressional budget hearings. These are serious charges that fueled the initial wave of complaints.

A second complaint was strategically withdrawn by its 17 original complainants. This move wasn’t a concession, but a calculated effort to streamline the process, consolidating support behind a similar complaint to expedite proceedings.

Chairman Luistro emphasized that dismissing the two complaints would allow the committee to concentrate its efforts, promising a more efficient assessment of the remaining cases. However, he cautioned that the sheer volume of documents and the breadth of the allegations suggest deliberations will still be extensive.

Speaker Faustino “Bojie” G. Dy III affirmed his commitment to a hands-off approach, stating he would not interfere with the committee’s work. He stressed the importance of the House functioning with professionalism, legality, and complete transparency throughout the process.

Political analysts are keenly observing the proceedings, anticipating intense scrutiny of how House leaders manage potential dissent, particularly among allies of the Vice-President. The handling of differing viewpoints will be a critical test of impartiality.

The institutional credibility of the House itself is on the line, according to Ateneo de Manila University assistant professor Arjan P. Aguirre. A rushed or overtly partisan process risks reinforcing the perception that impeachment is merely a political tool, rather than a constitutional safeguard.

The Makabayan bloc, which initially endorsed the dismissed complaint, vehemently disagreed with the committee’s decision. They argue the House possesses the authority to establish its own rules regarding impeachment and should not be deterred by legal uncertainties.

Former Party-list Rep. France L. Castro suggested the committee’s caution might be a preemptive measure to avoid potential challenges to the proceedings at the Supreme Court. This highlights the high stakes and legal complexities surrounding the case.

Now, the Justice committee will turn its full attention to the two remaining complaints, marking the beginning of a potentially lengthy and consequential process that could ultimately lead to a full-blown inquiry against the Vice-President.
