Assistant District Attorney Ken Zawistowski detailed the brutal reality of the shooting, describing how a bullet, fired during a routine traffic stop, bypassed Officer Diller’s protective vest. It tore through his abdomen, severing a vital artery and ripping through his intestines.

Despite the devastating injury, Diller fought back. Even in his final moments, with life slipping away, he managed to wrest the gun from his attacker’s grasp – a testament to his courage and dedication.

The trial of 35-year-old Guy Rivera commenced Tuesday in Queens Supreme Court, with the prosecution laying out a clear narrative. Rivera, seated in the passenger seat of a suspicious vehicle, allegedly opened fire on Officer Diller as he approached.

Body camera footage, too painful for Stephanie Diller to witness, showed the frantic attempts to save Officer Diller’s life. Dozens of officers, filling the courtroom and overflow rooms, sat in somber silence, many visibly moved by the unfolding testimony.

Rivera, a career criminal with a lengthy arrest record, has pleaded not guilty to first-degree murder. The shooting occurred on March 25, 2024, in Far Rockaway, after Diller investigated a vehicle parked outside a T-Mobile store.

The defense, led by Erin Darcy, presented a drastically different account. She argued the shooting was an “unintentional discharge” during a struggle as a sergeant attempted to remove Rivera from the vehicle, suggesting the NYPD bore responsibility for the tragedy.

Zawistowski countered this claim, emphasizing Rivera’s choices in those critical moments. He had the option to surrender his illegally possessed firearms – two loaded weapons hidden within the vehicle – but instead, he chose violence.

The weight of the loss was palpable, extending beyond the courtroom walls. Officer Diller was remembered not just as a police officer, but as a man with immense potential, dedicated to serving and protecting his community.

The trial is expected to last three weeks, a prolonged period of anguish for the Diller family and the entire NYPD. The promise of unwavering support from fellow officers offered a small measure of solace amidst the overwhelming grief.
