The proposed legislation centers around a newly structured oversight system, placing a Licensing Authority and a Gambling Commissioner at its core. Their mandate is clear: to safeguard consumers, uphold the integrity of the market, and aggressively combat financial crime – a response to evolving global challenges.

This new framework dramatically expands the scope of regulation, extending beyond gambling operators themselves. Marketing affiliates, software providers, and even complex ownership structures linked to gambling businesses will now fall under increased scrutiny.

A key shift involves cross-border licensing, asserting Gibraltar’s regulatory authority over companies even when gambling activity occurs outside its jurisdiction. This applies if key management or operational control remains firmly rooted within Gibraltar’s borders.

The bill demands a demonstrable “sufficient substantive presence” from businesses operating within Gibraltar. This means more than just a registered address; it requires genuine staffing, robust infrastructure, and a tangible contribution to the territory’s tax base.

Individual accountability is also heightened, with senior personnel facing rigorous vetting and potential designation as “regulated individuals.” This ensures that those at the top are directly responsible for compliance within licensed firms.

Recognizing the need for a smooth transition, existing operators will be granted a six-month window to adapt and apply for licenses under the new system, allowing continued operation while navigating the changes.

These changes arrive at a critical juncture for Gibraltar’s online gaming sector, which is currently navigating the impact of recent tax policy shifts in the United Kingdom. Increased remote gambling duties in the UK have sparked concerns about competitiveness and profitability.

The bill also equips the Gambling Commissioner with significantly enhanced enforcement powers, including the ability to demand information, levy penalties, and take decisive action against non-compliant companies. A new Gambling Appeals Tribunal provides operators with a formal avenue to challenge regulatory decisions.

Minister for Justice, Trade and Industry, Nigel Feetham KC, emphasized the government’s proactive response to the UK tax changes, stating a commitment to mitigating the resulting financial impact. He acknowledged the challenges but expressed confidence in the sector’s future growth and revenue potential.

The aim is not simply to react, but to proactively bridge the gap created by external factors and secure the long-term viability of Gibraltar’s gambling industry, ensuring it remains a responsible and competitive force in the global market.
