This loophole, the governors argue, allows states with large non-citizen populations to exert an unfair advantage in both lawmaking and the distribution of federal funds.

The attorneys general echoed these concerns, highlighting the “honor system” nature of current voter registration. Applicants often simply check a box affirming citizenship without providing any supporting documentation, a practice they believe is ripe for abuse.

The SAVE Act aims to close this gap by requiring documentary proof of U.S. citizenship upon registration for federal elections. Importantly, the attorneys general emphasize the bill wouldn’t federalize elections or disenfranchise eligible citizens, but rather reinforce existing state control over administration.
