Federal Judge Rules Key Provisions of Trump's Mail-In Ballot Executive Order Unenforceable

A federal judge has blocked key parts of President Trump's executive order on mail-in ballots. Boston-based US District Judge Indira Talwani, a judge appointed by a former President, made the decision to block President Trump's March 2025 executive order, specifically his attempt to create a federal voter list.

The executive order, which was signed in March 2025, aims to preserve and protect the integrity of American elections. According to the order, free and fair elections are fundamental to maintaining the constitutional Republic, and American citizens have the right to have their votes properly counted and tabulated without illegal dilution.

However, Judge Talwani sided with Democrat state attorneys general and stated that the Constitution does not grant the President any specific powers over elections. This decision is a blow to Trump, although an expected one, ahead of this fall's midterm elections.

The executive order had directed the creation of federal lists of voters and asked the Postal Service to only deliver mail ballots to certain people on those lists. But Judge Talwani's ruling has stopped the enforcement of this order, citing the Constitution's grant of control over election administration to the states.

This decision is not the first time a federal judge has blocked Trump's efforts to intervene in state-run elections. Just last week, another federal judge permanently banned Trump from implementing his executive order that required proof of citizenship when registering to vote.
