The lawsuit, filed by the estranged wife of the Senator’s former bodyguard, invokes the obscure legal concept of “alienation of affection.” Recognized in only a handful of states, this law allows a jilted spouse to seek compensation from the person they believe destroyed their marriage. The claim alleges intentional and malicious interference in a long-standing relationship.

Winning such a case is a formidable task. The plaintiff must prove the marriage was once loving and viable, that affection was demonstrably lost, and that the defendant directly caused that loss. The complaint meticulously details a timeline of the alleged affair, tracing the evolution of the relationship from professional security detail to something far more intimate.

According to the lawsuit, the connection unfolded through encrypted messages. One message, sent in June 2024, reportedly read, “I keep waking up during my sleep and reaching over for your arms to hold me.” Around the same time, the bodyguard allegedly stopped wearing his wedding ring, a subtle but telling sign.

The allegations don’t stop there. The complaint also references offers to provide a massage with a therapeutic device and even suggestions involving MDMA and a guided psychedelic experience – claims the Senator says she doesn’t recall. The details paint a picture of a deepening, and increasingly unconventional, connection.

Remarkably, the wife was, at times, present during the early stages of the relationship. The lawsuit describes a trip to Las Vegas for a U2 concert, where the three of them shared Dom Pérignon in a suite belonging to Cindy McCain. Later, they attended a Taylor Swift concert in Miami, ostensibly out of concern for the bodyguard’s children.

The situation reached a boiling point in October 2024, when the wife directly confronted the Senator via Signal, writing, “Are you having an affair with my husband? You took a married man away from his family.” The Senator acknowledged receiving the message, but maintains the affair occurred outside the jurisdiction of the court.

The lawsuit accuses the Senator of deliberately interfering with a marriage, seducing the bodyguard, and depriving the wife of the “warmth, companionship,” and love she once enjoyed. The Senator has admitted to the relationship, but argues the case should be dismissed due to lack of jurisdiction, claiming the intimate encounters occurred entirely outside the state where the lawsuit was filed.

While rare today, “alienation of affection” lawsuits have yielded substantial payouts in the past. One North Carolina case in 2010 resulted in a $9 million award, and another in 2018 saw damages totaling $8.8 million. These precedents underscore the potential financial stakes in this case.

The Senator, through her legal team, confirms the relationship became “romantic and intimate” in May 2024, during a trip to California, and continued in several other states. However, her lawyers emphasize that no intimate contact occurred within the state’s borders before the divorce was filed.

A judge has ordered the plaintiff to respond to the Senator’s motion to dismiss the lawsuit, setting the stage for a legal battle that could redefine the boundaries of heartbreak and accountability. The bodyguard himself filed for divorce earlier this year, adding another layer of complexity to this unfolding drama.
