The judge’s decision centers on the procedures followed by the Department of Homeland Security (DHS) when it moved to cancel the TPS designation for Ethiopia. Murphy determined that DHS failed to adhere to legal requirements, raising questions about the validity of the agency’s actions and the justification for ending protections for those fleeing instability in their home country.

This isn’t an isolated incident. Judge Murphy has become a recurring obstacle for policies originating from the previous administration, frequently finding fault with their implementation. The judge himself acknowledged the Supreme Court’s recent interventions in related TPS cases, but argued that the court’s decisions were not definitive enough to preclude his ruling. He pointed to the lack of explanation accompanying the Supreme Court’s stays, suggesting a cautious approach was warranted.

This latest ruling arrives alongside another recent decision where Murphy blocked a revised immunization plan proposed by a current administration official, finding it likely violated the law. This pattern has fueled accusations of selective application of legal principles and a bias against certain policies.

The lawsuit initiating this dispute was brought forth by an immigration advocacy group and three Ethiopian TPS holders, alleging that DHS acted with discriminatory intent. The plaintiffs claim the cancellation of TPS for several countries, including Ethiopia, was motivated by a desire to reduce the number of non-white immigrants in the United States.

The Department of Justice now faces a critical decision: appeal Murphy’s ruling and escalate the legal battle, or allow the injunction to stand, potentially delaying deportations for thousands of Ethiopian nationals. The outcome will undoubtedly have significant ramifications for immigration policy and the ongoing debate over the balance of power between the executive and judicial branches.
