A man wanted for murder in the Dominican Republic walked free in the United States, released by a federal judge despite a standing Interpol Red Notice and a deportation order. Bryan Rafael Gomez, a citizen of the Dominican Republic, had been held by Immigration and Customs Enforcement, but a judge overturned that detention, setting off a firestorm of controversy.

The case centers around U.S. District Judge Melissa DuBose, appointed by the previous administration, who ordered Gomez’s release from ICE custody. Her reasoning? She determined his detention was “continuous unlawful detention,” a claim fiercely disputed by ICE officials who argued Gomez was subject to mandatory detention due to the international arrest warrant for homicide.

The legal battle hinged on a technicality. Judge DuBose ruled that ICE was attempting to hold Gomez under a law intended for migrants apprehended *at the border*. Because Gomez was arrested by local police in Worcester, Massachusetts, following an assault and battery charge, she argued that law didn’t apply, and he was entitled to a bond hearing.

Gomez’s journey into the U.S. began in 2022, when he was initially apprehended and released by Border Patrol near Lukeville, Arizona. He remained free until his arrest in Massachusetts this April, triggering the ICE detainer and subsequent discovery of the international warrant. A $500 bail was initially set, then honored, leading to ICE’s intervention.

The warrant for Gomez’s arrest was issued in January 2023 by the Coordination of the Courts of Instruction in Santo Domingo, Dominican Republic, specifically for homicide. ICE officials have confirmed Gomez is also the subject of an Interpol Red Notice, a globally recognized alert for wanted persons.

Following Judge DuBose’s order, ICE is now legally barred from re-arresting Gomez. An immigration judge had already issued a deportation order on Tuesday, but that order is now effectively stalled. The situation has ignited debate about the balance between legal procedure and public safety.

The Department of Homeland Security characterized Gomez as a “criminal illegal alien” and expressed deep concern over his release. The agency emphasized the severity of the charges against him, highlighting the active international warrant for his arrest in connection with a homicide investigation.

This case raises critical questions about the interpretation of immigration law and the authority of federal judges in cases involving individuals wanted for serious crimes abroad. It underscores the complexities of navigating a legal system while simultaneously addressing concerns about national security and public safety.
