A staff member for Representative Veronica Escobar is at the center of a controversy involving alleged deception and security breaches at an ICE detention facility. The Department of Homeland Security has presented evidence suggesting Benito Torres, a senior caseworker, repeatedly misrepresented himself as an attorney to gain access to detainees.

The allegations first surfaced in March when the Acting ICE Director, Todd Lyons, notified Escobar about Torres’s actions at the Camp East Montana facility at Fort Bliss. Lyons requested clarification from the congresswoman regarding Torres’s claims of being legal counsel for detainees.

DHS asserts that Escobar did not provide a truthful response, instead publicly defending Torres and dismissing the accusations. The department has released documentation, including sign-in logs, purportedly showing Torres identifying himself as a “lawyer” during visits.

Records indicate the alleged misrepresentation began as early as September 2025. A memo from February details a January visit where Torres allegedly requested to see 22 detainees under the false pretense of being their attorney.

The most recent incident, occurring in January 2026, involved Torres allegedly passing a cell phone to multiple detainees during a visit. This act is considered a serious breach of security protocols, potentially jeopardizing the facility’s operations.

DHS contends that Torres’s actions were a deliberate attempt to undermine ICE’s mission of enforcing immigration laws. By falsely presenting himself as legal counsel, he engaged with detainees without proper authorization and introduced contraband into the facility.

Escobar has defended Torres, describing him as a “dedicated public servant” and Army veteran, and dismissing the accusations as “unfounded.” She has also been critical of the detention facility itself, citing concerns about conditions and a lack of adequate care.

The congresswoman has previously called for the closure of the Camp East Montana facility, labeling it “disastrous and inhumane.” She has also accused ICE of retaliatory tactics and obstructing congressional oversight.

Escobar has highlighted a series of issues at the facility, including deaths, disease outbreaks, and allegations of waste, fraud, and abuse. She claims ICE has been unresponsive to her inquiries regarding these concerns.

As a result of the allegations, Torres has been barred from entering any ICE facilities. The situation continues to draw scrutiny, raising questions about access to detainees and security within immigration detention centers.
