On January 6th, a wave of individuals who were present at the U.S. Capitol are now pursuing substantial financial compensation from the federal government. A lawsuit, recently filed in Florida, directly challenges the actions of the U.S. Capitol Police and the Metropolitan Police Department of Washington, D.C.

The core allegation centers on the use of excessive and what plaintiffs describe as “indiscriminate” force against those gathered at the Capitol. This alleged overreach resulted in both physical harm and deep emotional distress for many present that day.

According to the lawsuit, officers deployed a range of crowd-control measures – rubber bullets, chemical sprays, and flashbangs – with a reckless disregard for who they impacted. Crucially, the suit claims these measures affected individuals who were not actively involved in any violent confrontations.

Attorneys representing the plaintiffs argue that law enforcement failed to make a critical distinction between peaceful demonstrators exercising their rights and those engaged in disruptive or unlawful behavior. This lack of discernment, they contend, led to unjustifiable injuries.

The lawsuit vividly describes a scene where “explosive munitions, chemical agents, and impact projectiles” were launched into a crowd, with officers themselves acknowledging on video that these projectiles were “hitting innocent people” even an hour after the deployment began.

Among those leading the charge is A.J. Fischer, a veteran of the Air Force who previously faced assault charges but later received a pardon. He stands alongside Patrick and Marie Sullivan, who were directly struck by pepper balls and exposed to chemical agents despite not being accused of any wrongdoing.

The plaintiffs aim to establish a broader class action, potentially encompassing dozens more individuals who were present on the Capitol’s West Front during the events of January 6th. This would significantly expand the scope of the legal challenge.

This case emerges against a backdrop of prior settlements reached by the Trump administration in related, high-profile cases. These include a multimillion-dollar settlement with the estate of Ashli Babbitt, who was fatally shot inside the Capitol building.

Another significant settlement involved Michael Flynn, the former national security advisor, who received $1.25 million. These prior resolutions suggest a pattern of financial redress for individuals connected to the events surrounding January 6th.
