The legal battle surrounding Cole Allen, accused in the shooting near the White House Correspondents’ Association Dinner, took an unexpected turn. His defense team abruptly withdrew a motion seeking to remove him from suicide watch, discovering the restriction had already been lifted by jail officials.

This revelation rendered their previous request moot, prompting a plea to the court to cancel a scheduled hearing. Allen’s attorneys learned he was no longer under 24-hour observation at the D.C. Jail, a status that involves complete lockdown within a specially designed “safe cell.”

Previously, the defense had argued the suicide watch was a violation of Allen’s rights, severely limiting his ability to prepare for his defense. The restrictions prevented access to a jail tablet for communication with family and crucially, the ability to review legal documents provided by his counsel.

The motion detailed the indignity of the situation, describing forced strip searches, constant escorting even to basic necessities like the shower, and the requirement to wear a padded vest while confined to his cell. These conditions, the defense argued, were unnecessary and infringed upon Allen’s due process rights.

Meanwhile, the prosecution signaled an escalation of the case. A U.S. Attorney stated plans to present evidence to a grand jury this week, hinting at the possibility of additional charges beyond those already filed against Allen.

Allen, a 31-year-old computer scientist from California, is currently facing federal charges, including the attempted assassination of the president. The incident occurred on April 25th, when he allegedly breached a Secret Service checkpoint armed with multiple weapons.

The case continues to unfold as the prosecution builds its case and the defense navigates the complexities of preparing a defense under intense scrutiny. The court’s decision regarding the canceled hearing remains pending, adding another layer to this rapidly developing situation.
