A single night of unchecked indulgence aboard a cruise ship has resulted in a staggering $300,000 judgment against a major cruise line. Diana Sanders, a 45-year-old nurse, was awarded the sum after a federal jury found Carnival Cruise Line negligent in a case stemming from a devastating fall.

The incident unfolded on January 5th, 2024, aboard the Carnival Radiance. Sanders was served an alarming number of tequila shots – at least fourteen – over a nearly nine-hour period, beginning in the late afternoon and continuing late into the night.

The consequences were severe. Sometime between 11:45 p.m. and 12:20 a.m., Sanders plummeted down a flight of stairs. The fall left her with a concussion, persistent headaches, and injuries to her back, tailbone, and sustained significant bruising.

More concerning, medical evaluations suggested a potential traumatic brain injury. The lawsuit detailed the extent of her suffering, painting a picture of a life irrevocably altered by the events of that night.

A crucial piece of evidence presented to the jury was 30 minutes of missing surveillance footage. This gap in the recordings captured the period between Sanders leaving the casino bar and her discovery unconscious in a restricted, crew-only area of the ship.

Her attorney, Spencer Aronfeld, described the legal battle against Carnival as a “massive undertaking,” expressing profound respect for his client’s unwavering resilience throughout the 18-month litigation. He emphasized the case’s broader implications.

Aronfeld argued that all-inclusive drink packages create a dangerous environment, incentivizing excessive alcohol consumption and placing undue pressure on servers who prioritize tips over the safety and well-being of passengers.

Carnival Corporation has publicly stated its disagreement with the verdict, asserting grounds for appeal and intending to pursue a new trial. The company maintains its position on the matter.

This case echoes a similar, ongoing legal challenge involving Royal Caribbean. The fiancée of a man who died during a cruise has filed a wrongful death suit, alleging the cruise line served him an excessive amount of alcohol – at least 33 drinks – and was responsible for his death following an altercation with ship staff.

The details of that case are harrowing, with allegations that ship personnel physically restrained the man, using their full body weight in the process. Both cases raise critical questions about the responsibility of cruise lines to protect passengers from the dangers of over-consumption.
