Louisiana is poised to dramatically reshape its approach to online gaming, moving to decisively shut down a burgeoning world of illegal sweepstakes-style platforms. A sweeping bill, House Bill 883, has sailed through the House with near-unanimous support and is now under consideration by the Senate.

The legislation doesn’t mince words, defining illegal online gambling as any game or contest accessed via the internet where a person risks something of value for the chance of profit. This isn’t simply about traditional casino games appearing online; lawmakers are specifically targeting newer, more subtle formats designed to skirt existing laws.

At the heart of the issue are platforms utilizing “dual-currency” systems. These sites allow users to accumulate virtual credits, then exchange them for prizes or cash equivalents, effectively mimicking the mechanics of traditional gambling while presenting a veneer of legality.

The consequences for those involved could be severe. Casual users face potential fines up to $500 and even jail time of up to six months. But the real weight of the law falls on operators and those who support these systems.

Individuals building or running these platforms could face fines reaching $100,000 and prison sentences of up to five years. The bill doesn’t stop there, extending to the financial infrastructure that enables these operations.

Merchant payment processors are explicitly prohibited from handling transactions linked to unlawful gaming activity. Online platforms that knowingly host or transmit gambling-related content face similar restrictions, with each wager potentially constituting a separate violation and escalating penalties.

The state Attorney General will be granted significantly expanded authority to intervene directly. This includes the power to issue cease-and-desist orders, demanding immediate shutdown of prohibited activity within ten days.

Failure to comply with these orders could lead to court actions, including website blocking, account freezes, and the disruption of financial flows. Attorney General Liz Murrill has already signaled her intent to aggressively enforce the law, declaring these online sweepstakes casinos illegal.

This push for stricter regulation comes after previous attempts to address the issue faced roadblocks, revealing divisions among regulators, lawmakers, and the governor’s office. However, a clear momentum is building for a more decisive approach.

Supporters of the bill emphasize the need to adapt to evolving online gambling models and the networks that support them. They argue that these illegal operations undermine public trust in legitimate, regulated gaming and divert crucial tax revenue from essential state services.

Importantly, the legislation is designed to avoid disrupting existing, legally sanctioned gaming activities. Licensed casinos, regulated sports betting, and approved fantasy sports operations will remain unaffected, provided they adhere to current regulations.
