UMVA has learned that a healthcare executive and her husband have narrowly avoided prosecution after a disturbing incident left their six-month-old baby alone on a Florida beach.
Sara Wilkes, 37, and Brian Wilkes, 40, were arrested last October after deputies responded to reports of an unattended infant at Miramar Beach. The Texas couple were charged with child neglect without great bodily harm, but prosecutors have agreed not to pursue the case if they meet certain conditions.
Under a deferred prosecution agreement, the pair must pay a $1,000 fine each, complete 25 hours of community service, and attend a parenting class. They've also been barred from Walton County, Florida - all 1,240 square miles of it - for the duration of the agreement.
The incident occurred near the Hilton Sandestin Beach Golf Resort and Spa on Florida's Gulf Coast. Members of the public discovered the baby alone and cared for her until emergency services arrived. By the time deputies arrived, the baby's vital signs were normal, and she was not in obvious physical distress.
Authorities say the couple admitted leaving the infant behind while they went elsewhere with their three other children. They claimed to have put the baby down for a nap beneath a beach tent and then 'lost track of time' while on a walk - without taking a mobile phone with them.
Surveillance footage reviewed during the investigation revealed the couple's alarming lack of caution. The Florida Department of Children and Families attended the scene, and the couple's other children were temporarily placed into state custody until relatives from Texas arrived to collect them.
The case sparked widespread outrage, with Walton County Sheriff's Office Major Dustin Cosson publicly condemning the couple's actions. He emphasized that leaving a baby alone on a beach for an extended period was unreasonable and posed significant risks to the child's safety.
Cosson highlighted the potential dangers, including suffocation, and stressed that visitors must exercise common sense while on holiday. The deferred prosecution agreement means the case will not proceed if the couple satisfies all the requirements.
