A stark refusal has landed in Paris. The U.S. Justice Department has firmly blocked French authorities from investigating Elon Musk’s social media platform, X, escalating a growing international dispute.

The DOJ, through its Office of International Affairs, delivered a pointed letter asserting that the French investigation represents a blatant attempt to regulate an American company using the force of criminal law. Officials believe the probe fundamentally clashes with the protections afforded by the First Amendment of the U.S. Constitution.

According to the Justice Department, France’s actions aren’t a legitimate pursuit of justice, but rather a calculated effort to control the global conversation happening on X. They characterize it as an attempt to “wrongfully regulate through prosecution” the business operations of a major social media platform.

French authorities initiated their investigation into X in early 2025, a pursuit that dramatically escalated with a raid on the platform’s Paris office just this February. Repeated requests for U.S. assistance have followed, specifically seeking to compel testimony from Musk and other key executives.

The scope of the French inquiry is broad, encompassing allegations of algorithmic bias, the spread of deepfakes, and the presence of content prohibited under French law – including deeply offensive material like Holocaust denial. X has consistently maintained its innocence, dismissing the investigation as a politically motivated act of censorship.

The company expressed gratitude for the Justice Department’s intervention, hoping it will force French authorities to reconsider their approach. They believe the investigation is entirely without merit and should be swiftly terminated.

French prosecutors initially claimed they were unaware of the DOJ’s letter, emphasizing the independence of their judicial system. However, the incident highlights a growing tension between differing approaches to online content moderation and free speech.

Since acquiring the platform in 2022, Elon Musk has dramatically altered its content policies, largely dismantling previous censorship practices and rebranding the service as X. This shift has placed the platform at odds with European regulators, who often take a more restrictive stance.

France, like many European nations, has a reputation for strict regulations regarding speech, particularly concerning viewpoints considered conservative or nationalist. This isn’t an isolated incident; in April 2024, French authorities arrested Telegram CEO Pavel Durov in Paris, accusing the platform of failing to adequately address illegal content.

Durov’s arrest, involving allegations of terrorism-related material, child exploitation, and fraud, underscores France’s willingness to aggressively pursue tech executives over content moderation policies. His case remains ongoing, adding another layer to the complex debate surrounding online regulation and freedom of expression.
