A quiet battle is underway, one far removed from the headlines dominated by tariffs and trade wars. The current administration is confronting a decades-long pattern of exploitation, a systematic undermining of American ingenuity by foreign governments, as the President bluntly described it.

While tariffs have captured public attention, a more subtle – and potentially more impactful – strategy is unfolding. Behind closed doors, pressure is mounting on nations to respect and protect American intellectual property, the lifeblood of innovation and economic growth.

America’s economic future hinges on companies willing to take enormous risks, investing heavily in research and development to bring groundbreaking technologies to market. Without robust intellectual property protections, these investments are vulnerable, stifling progress and ultimately harming all Americans.

The numbers are staggering: industries reliant on strong IP contribute nearly half of U.S. GDP and support over 62 million jobs. Protecting these assets isn’t just about corporate profits; it’s about safeguarding the nation’s economic engine.

The pharmaceutical industry is a prime example of this vulnerability. American companies lead the world in drug development, yet foreign governments routinely devalue these life-saving treatments through price controls, regulatory delays, and other tactics designed to suppress spending on American innovation.

This practice effectively shifts the cost of innovation onto American patients, allowing other nations to benefit from American research without bearing the financial burden. It’s a form of free-riding that undermines the entire system.

The European Union’s recent pharmaceutical legislation exemplifies this trend, shortening market exclusivity periods for new drugs and erecting burdensome regulatory hurdles. Even more concerning, the EU is considering measures that would compel companies to surrender their patented technologies.

Mexico, too, is falling short of its commitments under the USMCA trade deal, allowing generic manufacturers to launch products prematurely, before American innovators have a fair chance to defend their patent rights. This lack of enforcement threatens the future of biotechnology innovation.

The administration isn’t standing idly by. A recent agreement with the United Kingdom, linking tariff exemptions to increased spending on medicines and limitations on revenue clawbacks from biotech firms, demonstrates a willingness to leverage trade deals for IP protection.

Furthermore, the administration is actively blocking the import of infringing products – from pharmaceuticals to computer chips – sending a clear message that IP theft will not be tolerated. This includes direct intervention in legal battles, as seen with the Department of Justice and Patent and Trademark Office’s support of a startup accusing a major tech company of stealing its technology.

More can be done. Congressional action on the RESTORE Patent Rights Act would empower courts to issue injunctions against patent infringers, providing a crucial deterrent. Placing the European Union on the Special 301 watchlist would further escalate pressure to reform its practices.

The upcoming USMCA review presents another opportunity to hold Mexico accountable for its commitments. These actions, combined with the ongoing quiet diplomacy, represent a comprehensive effort to reshape the global trading system.

While tariffs may grab the headlines, this broader, more strategic push to defend American intellectual property may ultimately prove to be the most significant step towards a fairer and more prosperous future for American innovators, workers, and investors.
