Utah Judge Tony Graf has come under fire for delaying his decision on the Charlie Kirk murder case, which will determine whether the case goes to trial. Fox News host Kayleigh McEnany has spoken out against Graf, calling the delay "inexcusable" and stating that it denies the victim's family their right to a speedy disposition of the charges.
The case revolves around the shooting death of Charlie Kirk, the founder of Turning Point USA, who was killed on September 10, 2025, at Utah Valley University. Prosecutors are seeking the death penalty and have presented evidence that includes statements from Tyler Robinson, the suspect, who allegedly confessed to the crime on multiple occasions.
McEnany pointed out that Graf cited Article I, Section 28 of the Utah Constitution, which requires the family to be treated with respect and dignity, but failed to mention Utah code 773872, which grants the right to a speedy disposition of the charges. She argued that the delay in making a decision on probable cause is unacceptable, given the overwhelming evidence presented in the preliminary hearing.
The preliminary hearing concluded on July 10, 2026, with Judge Graf announcing that he would not make a decision on whether the case goes to trial until at least September. McEnany expressed her outrage, stating that it is unacceptable for the defendant to have Sixth Amendment rights to a speedy trial while the victim's family is denied their right to a speedy disposition of the charges.
The Kirk family released a statement after the preliminary hearing, expressing their gratitude for the support and kindness extended to them during this difficult time. They acknowledged that the loss of their loved one cannot be undone, but prayed that truth will continue to be heard through a fair and transparent process.
