However, U.S. District Judge Colm Connolly swiftly dismissed these arguments as “political,” not legal. He emphasized that the court was not the appropriate venue for challenging broader government policies, and firmly rejected the state’s attempt to frame the issue as a matter of principle.

The data in question is deeply personal, encompassing employees’ names, Social Security numbers, and wage information collected through Delaware’s unemployment insurance system. Investigators intend to cross-reference this data with on-site observations and identify potentially fraudulent documentation.

Judge Connolly, appointed by former President Trump, determined the subpoena was entirely lawful, directly relevant to a legitimate investigation, and did not impose an unreasonable burden on the state. He noted the request covered a limited timeframe – two quarters for fifteen businesses – making compliance feasible.

The judge also challenged Delaware’s claim that releasing the data would damage its unemployment insurance system, deeming the assertion unsupported. He expressed skepticism towards the state’s pessimistic view of its employers, suggesting a lack of faith in their compliance with the law.

This ruling represents a clear setback for Delaware, which had previously ignored multiple ICE subpoenas earlier in the year, ultimately prompting the federal government to pursue legal action. The state’s initial silence and lack of response further fueled the legal battle.

Benjamin Wallace, the newly appointed U.S. Attorney for Delaware, hailed the decision as a reaffirmation of federal authority. He stated that federal law applies universally, regardless of an entity’s status or alignment with federal policy objectives.

The dispute’s escalation highlights a broader trend of the federal government seeking to expand its reach in immigration enforcement, potentially impacting states with more protective policies. Delaware officials have yet to announce whether they intend to appeal the judge’s order, leaving the future of the data release uncertain.
